Terms and Conditions

1. Introduction

These Terms and Conditions govern the purchase and use of the Tourette Functional Analysis service (the “Service”).

By purchasing, accessing, or participating in the Service, you agree to these Terms and Conditions, together with any checkout terms, refund terms, privacy terms, and service descriptions provided to you at the time of purchase.

If you are purchasing the Service on behalf of a child or dependent, you confirm that you are the child’s parent, legal guardian, or otherwise authorized to provide information and make decisions related to the Service.

2. Nature of the Service

The Tourette Functional Analysis is an information-gathering and reporting service designed to help identify patterns, influencing factors, functional relationships, fatigue, energy, recovery patterns, and priority opportunities related to tic-related challenges.

The Service is educational and informational in nature.

The Service is not:

• Medical care
• Psychological treatment
• Psychotherapy
• Behaviour therapy
• CBIT treatment
• Coaching
• Crisis intervention
• Emergency services

The Service does not diagnose, treat, prevent, or cure Tourette syndrome, tic disorders, mental health conditions, neurological conditions, or any other medical or psychological condition.

No diagnosis, treatment outcome, cure, symptom reduction, functional improvement, or specific result is guaranteed.

3. Not a Substitute for Professional Care

Reports, findings, observations, and priority areas identified through the Service are intended to support understanding and further discussion.

They should not be interpreted as medical advice, psychological advice, therapeutic advice, educational advice, or instructions that a family must follow.

Clients are encouraged to consult qualified healthcare, mental health, educational, behavioural, or other regulated professionals before making decisions about diagnosis, treatment, therapy, medication, school accommodations, or other health-related matters.

If you or the person you are purchasing for is experiencing a medical emergency, mental health crisis, risk of harm, or urgent safety concern, contact emergency services or a qualified crisis service immediately.

4. Client Responsibilities

Clients agree to provide information that is accurate and complete to the best of their knowledge.

The quality and completeness of the Service depend on the information provided through intake materials, tracking forms, interviews, communications, and related submissions.

Clients are responsible for deciding what information to share and for informing the Service Provider if information previously provided is inaccurate, incomplete, or materially changes.

Clients understand that findings and priorities may change over time or if additional information becomes available.

5. Report Findings

Reports are intended to identify patterns, possible influencing factors, areas of uncertainty, and potential opportunities for further investigation or support.

Report findings may include observations related to factors such as sleep, stress, fatigue, school or work context, transitions, sensory load, suppression effort, social demands, environment, routines, family accommodation, and recovery.

Findings are based on available information and should be understood as interpretive and informational rather than definitive.

6. Data Collection for the Service

The Service may include:

• Intake questionnaires
• Tracking forms
• Surveys
• Interviews
• Observation notes
• Follow-up communications
• Context mapping
• Report preparation
• Related administrative communications

Participation in tracking activities is voluntary. However, incomplete, inconsistent, or limited participation may affect the completeness or usefulness of the analysis.

By participating in the Service, you consent to the collection, use, review, organization, and analysis of the information you provide for the purpose of delivering the Service, preparing the report, communicating with you, administering the client relationship, and maintaining appropriate business records.

7. Optional Research and De-Identified Data Use

During intake, clients may be invited to provide separate optional consent for de-identified or aggregate information to be used for research, methodology improvement, education, publication, internal analysis, or related purposes.

This consent is optional.

Declining optional research or secondary data use will not affect your ability to purchase or receive the Tourette Functional Analysis Report.

Where optional research or secondary data use is offered, it will be presented separately from the purchase terms and service consent.

If you provide optional research consent, reasonable steps will be taken to remove or minimize direct identifying information before information is used for those purposes. However, no de-identification process can guarantee that re-identification is impossible, particularly where information is unusual, detailed, or relates to a small group.

Clients may withdraw optional research consent by contacting the Service Provider. Withdrawal may not affect information that has already been de-identified, aggregated, incorporated into completed analysis, or used in materials that have already been created or published.

8. AI-Assisted Analysis

The Service may use software, automation tools, and artificial intelligence systems to assist with:

• Data organization
• Data cleaning
• Pattern identification
• Summarization
• Drafting support
• Report preparation
• Administrative workflows

AI systems are used as analytical and drafting tools only.

Final findings and reports are reviewed by a human reviewer before being delivered.

Where reasonably possible, identifying information is removed, minimized, or limited before data is processed through AI systems.

Clients understand that AI-assisted tools may produce errors, omissions, or incomplete outputs, and that human review is used to reduce but not eliminate these risks.

9. Confidentiality and Security

Reasonable administrative, technical, and organizational steps will be taken to protect the confidentiality and security of client information.

However, no electronic system, communication method, software platform, cloud service, or data storage system can guarantee absolute security.

Clients should avoid submitting information they do not want reviewed for the purposes of the Service.

Information may be accessed by the Service Provider, authorized personnel, contractors, software providers, payment processors, form platforms, storage providers, AI tools, or other service providers as reasonably necessary to operate, administer, and deliver the Service.

Additional privacy practices may be described in the applicable Privacy Policy.

10. Intellectual Property

The methodology, forms, templates, reports, frameworks, educational materials, written content, processes, and other materials provided through the Service remain the intellectual property of the Service Provider unless otherwise stated.

Clients may use their own completed report for personal, family, medical, educational, or care-planning purposes.

Clients may share their own report with healthcare professionals, educators, therapists, or other support providers involved in their care or the care of the person who is the subject of the report.

Reports, templates, forms, frameworks, and related materials may not be reproduced, sold, republished, adapted, distributed commercially, or used to create competing services without written permission.

11. Fees, Checkout Terms, and Refunds

Fees are due as described at the time of purchase.

The checkout page or purchase process will identify the Service being purchased, the price, applicable taxes or fees where relevant, the general nature of the deliverables, and the refund terms applicable to the purchase.

By completing your purchase, you agree to the Terms and Conditions, Privacy Policy, Refund Policy, and any product-specific terms shown or linked at checkout.

The refund terms shown at checkout apply to your purchase and are incorporated into these Terms.

Because the Tourette Functional Analysis Report involves reserved assessment time, intake review, tracking setup, analysis, and preparation of individualized findings, purchases are generally non-refundable once intake materials have been submitted or assessment work has begun.

If a client requests cancellation before submitting intake materials and before any assessment work has started, a partial refund may be offered at the Service Provider’s discretion, less any payment processing fees, administrative costs, or work already completed.

No refunds are available once tracking materials have been prepared, analysis has commenced, individualized report work has begun, or the written report has been delivered, except where required by law.

Refund requests must be submitted in writing to the contact email listed below.

Nothing in these Terms limits any refund, cancellation, chargeback, consumer protection, or other legal rights that cannot be limited by contract.

12. Payment Processing

Payments may be processed by third-party payment providers.

The Service Provider is not responsible for delays, errors, declines, chargebacks, processing failures, account holds, or other issues caused by third-party payment systems, except to the extent required by law.

Clients are responsible for ensuring that payment information is accurate and authorized.

13. Scheduling, Timelines, and Delivery

Estimated timelines may be provided at the time of purchase or during intake.

Timelines may depend on client responsiveness, completion of intake materials, tracking participation, scheduling availability, technical issues, and the complexity of the information submitted.

Reasonable efforts will be made to deliver the Service within any stated timeframe, but timelines are estimates unless expressly stated otherwise in writing.

14. Limitation of Liability

To the maximum extent permitted by law, the Service Provider will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to the Service.

To the maximum extent permitted by law, the Service Provider’s total liability for claims arising from or related to the Service will not exceed the amount paid by the client for the Service giving rise to the claim.

Nothing in these Terms limits liability where such limitation is prohibited by law, including liability arising from gross negligence, wilful misconduct, fraud, or rights that cannot be waived under applicable consumer protection legislation.

Participation in the Service is voluntary and undertaken at the client’s own discretion.

15. Governing Law and Ontario Courts

These Terms and any dispute arising from or related to the Service are governed by the laws of the Province of Ontario and the applicable laws of Canada.

Subject to any rights or remedies that cannot be limited under applicable law, the parties agree that any court proceeding arising from or related to these Terms or the Service will be brought before the courts located in Ontario, Canada.

Nothing in this section limits any consumer protection, privacy, health, accessibility, or other legal rights that cannot be limited by contract.

Nothing in these Terms requires arbitration or prevents a consumer from exercising court rights that cannot be waived under applicable law.

16. Changes to These Terms

These Terms may be updated periodically.

The version in effect at the time of purchase will apply to the Service purchased, unless a change is required by law or the client expressly agrees to updated terms.
